Edward Faulks KC specialises in clinical negligence, personal injury, police law and claims arising from the Human Rights Act.

During his time in practice, Edward has appeared in c.25 cases in the House of Lords and the Supreme Court and over 100 cases in the Court of Appeal. He is also instructed in many group actions and enquiries.

Between 1998 and 2007 Edward was head of Chambers at 1 Chancery Lane and clients say he creates a cool and calm atmosphere. 

Edward contributed to “Local Authority Liability” (Morrell & Foster, 4th edition). In 2006 he also was a special adviser to the Department of Constitutional Affairs on the Compensation Culture.

Since returning to the Bar full time after a 3 year term as a Minister of State at the Ministry of Justice, Lord Faulks KC has been instructed in a number of high profile cases.

As well as being highly ranked in Chambers & Partners and Legal 500, he is also recognised in Best Lawyers UK for excellence in Clinical Negligence, Personal Injury and Police Law. Edward has been shortlisted for Personal Injury Silk of the Year at the Legal 500 Bar Awards 2024.

Edward has been instructed in a large number of the leading cases in relation to Clinical Negligence and Healthcare, as well as the areas that they cross over into – Personal Injury, Police Law, Local Government and Public Sector & Human Rights law, over the last 10 years and is regarded as being one of the most highly regarded Appellate silks of his generation.

Edward continues to be instructed by both claimants and defendants in high value and complex claims such as the recent novel sports law case of Tylicki v Gibbon in the High Court in which the claimant succeeded in establishing negligence against a fellow flat race jockey. This followed a professional race in which the claimant’s horse was caused to fall when the Defendant cut across him as he came up along the rail. The claimant had been left paraplegic with injuries valued at circa £6million.

Edward acts in a range of high profile, complicated and high value police law claims. He recently acted for the defendant in Goodenough v Thames Valley Police, a high profile case concerning the death of a man in police custody, shortly after the car which he had been driving had been stopped.

As well as in clinical negligence, personal injury and police law, Edward specialises in claims arising from the Human Rights Act.

Recently he has had success in the Supreme Court in CN v Poole, in which the judgment sets out what liability local authorities face when dealing with child safeguarding. Barclays Bank, another Supreme Court case, is now the leading authority for the crucial issue it covers – vicarious liability.
