Ben Hicks is a experienced barrister whose specialised practice encompasses a wide range of personal injury and clinical negligence claims.

His work is geographically wide-ranging and he is regularly instructed in both County Court and High Court claims.

His practice regularly involves matters arising from very serious injury and which result in profound disability. He has particular expertise in claims involving fatal accidents and lost years claims.

Ben recognises that involvement in litigation is a profoundly stressful and potentially traumatic experience for Claimants. He is committed to providing constructive and practical advice aimed at securing the best possible outcome whilst providing reassurance and support to his clients.

Ben’s busy clinical negligence practice involves him being instructed exclusively for Claimants in this field, having gained substantial and wide-ranging experience in claims involving a range of healthcare professionals. He is regularly instructed at all stages of litigation to provide advice and advocacy in relation to complex issues arising in relation of both liability and quantum.

His recent cases have involved matters including:

  • Missed opportunity to diagnose an aortic aneurysm, resulting not only in the death of the affected individual, but secondary psychiatric injury to his wife.
  • Inadequate podiatric care leading to the loss of a diabetic Claimant’s entire leg.
  • Failure to proceed timeously to caesarean section, resulting in the death of the baby and profound psychiatric injury to both parents.
  • Poor management of labour and delivery, resulting in neurological injury to a child and significant injury to his mother.
  • Inappropriate choice of surgical technique for breast augmention, leading to a catastrophic cosmetic outcome.
  • Delayed diagnosis of a range of cancers, often giving rise to complex issues of causation.
  • Defective surgical equipment resulting in significant injury to the Claimant’s gastrointestinal tract.
  • Failed sterilisation.

Ben’s personal injury practice involves cases concerning a wide range of liability issues, including road traffic accidents, employers’ and public liability claims and assaults. He also has substantial expertise in product liability claims, including although not limited to those involving defective medical devices and equipment.

Within the field of personal injury, Ben also has extensive experience in representing Defendants in cases involving a wide range of fraudulent claims. His recent work has included claims involving allegations of staged and induced accidents and “phantom” passengers.

Ben’s recent cases have involved matters including:

  • RTA resulting in profound spinal injury, where significant issues of contributory negligence were eventually abandoned shortly before trial.
  • Catastrophic failure of work equipment resulting in loss of an arm and development of CRPS.
  • Sexual harassment within the workplace, resulting in profound psychological harm and loss of chance in relation to anticipated career progression.
  • Multiple vehicle collision arising from the escape of a dog onto the highway.

In addition to his experience in personal injury and clinical negligence litigation, Ben is also instructed in claims arising out of the allegedly negligent handling of such matters.
