Tom Little appears in Administrative Court in important human rights challenge to the level of force that a householder can use on a burglar

Tom Little instructed by the Secretary of State for Justice appears in the Administrative Court before the President of the Queen’s Bench Division and Mr Justice Cranston. The claim, which is resisted by the Secretary of State, alleges that the law of self-defence applying when a householder uses force on a burglar is incompatible with the Article 2 right to life of the trespasser/burglar.

The Claimant seeks a declaration that section 76(5A) of the Criminal Justice and immigration Act is incompatible with the Human Rights Act.

The hearing on 17th November 2015 has been adjourned part heard until 7th December 2015.
