Negotiating disputed living and contact arrangements for children and, when negotiation fails, appearing before the family courts in order to obtain a just resolution, particularly in cases where one party is, in fact, seeking to frustrate contact, whilst professing to encourage it.

Parental responsibility disputes, where one party has sought to exclude the other from information or consultation concerning the choice of nursery and/or school, holidays, relocation and medical decisions.

Fact finding, non-molestation and occupation order hearings concerning allegations of harm, where the outcome will largely pre-determine the finality of child arrangement and/or financial order applications.

Contested financial proceedings, particularly where one party attempts to understate/undervalue assets or use subterfuge/financial superiority in order to retain an unfair advantage.

Marc is frequently instructed in matters where rigorous analysis of evidence and thorough cross-examination of witnesses is required. Many cases involve allegations of physical, sexual and emotional abuse, where the potentially life-changing consequences for a client are never underestimated. As an experienced trial lawyer, Marc has successfully acted in matters which have extended to related criminal and civil proceedings and has considerable experience in dealing with cases where CAFCASS, social services or the courts have misinterpreted matters and are openly hostile to one party.

• LBC v SR: Children Act 1989 proceedings with a 20-day split fact-finding/final hearing into custody and contact, allegations of spousal rape, domestic violence, violence and neglect towards children and fabrication of audio evidence and documents.
• R v R: Ancillary relief/financial provision proceedings involving significant asset base (including four limited companies and multi-jurisdictional assets), allegations of bigamy, forgery and asset concealment.
• LBS v JR: Children Act 1989 proceedings with a rolled-up final hearing into residence and contact, allegations of drug and alcohol abuse and neglect of children.
• T v T: Occupation order proceedings, domestic violence, immigration status.
• MCC v X: High Court proceedings with “baby shaking” allegations resulting from brain injury to a child, with multiple expert medical witnesses.
• SN v RN: Matrimonial finance proceedings concerning alleged covert disposal of £1.7 million received from the sale of a defence consulting business. Allegations of H leading a “triple life” whilst simultaneously being in ongoing relationships with 3 women at the same time and secretly spending money on houses, a villa in Ibiza – and a Ferrari.
• JC v SN: Children Act 1989 relocation proceedings, with M seeking to take the child away from London, to live on the other side of the UK, against F’s wishes.
• LBW v AA: 10 day trial concerning skull fractures sustained by a 3 year old child whilst in the care of her parents – cross-examination of consultant paediatrician, professor of paediatric neuroradiology and paediatric neurosurgeon.
• SC v PC: 3 day trial matrimonial finance trial concerning ownership of a large home in France.
• R v R: Matrimonial finance proceedings concerning a lengthy marriage and the consideration of various business enterprises which occurred during it, including the construction of the world’s biggest yacht, the creation of a FTSE 250 company and six figure profits from stockbroking and property investments, all of which were lost due to bad investments.
• RR v LR: acting for a former Premiership football player in matrimonial proceedings concerning an attempt to seize his pension, held in a trust in Lichtenstein.
