Kerry Nicholson takes instructions across most of Chambers’ core areas, and has a particular interest in clinical negligence, inquests, police law, travel law, personal injury, professional negligence and public law.

She appears in Court regularly, and has appeared on all tracks. She has also been appointed Junior Junior Counsel to the ongoing Undercover Policing Inquiry.

Prior to joining Chambers, Kerry worked at the Government Legal Department. During that time she worked across a variety of departments, including advising the Home Office on immigration litigation, working in the Attorney General’s Office in the Public Law and Litigation Team, and the Department for Transport working on legislative issues.

Before joining the Bar, Kerry worked as a legal and policy adviser to the independent press at the News Media Association, advising on issues relating to freedom of expression, competition law, election law and commercial issues. She has also worked with the Texas Defender Service in Houston, a legal charity that represents those on or facing death row.

Kerry has a busy practice across all areas of clinical negligence and healthcare, acting for both claimants and defendants. She has a particular interest in cases that have a public law element.

She is regularly instructed in claims involving complex issues on causation, failures to diagnose, as well as claims concerning the Fatal Accidents Act. Her recent cases have included negligently conducted gynaecological surgeries, complications arising from dementia, failures to diagnose cancer, and failures in caring for children with mental health issues.

Kerry takes instructions across all areas of personal injury, and appears in court on a regular basis for both claimants and defendants on claims including employer’s liability, occupier’s liability, road traffic accidents and public authority liability.

She also has a busy paper work practice, advising on liability and quantum and drafting pleadings.

Kerry accepts instructions across all professional indemnity work, acting for both claimants and defendants in professional liability claims in a wide variety of sectors.

In particular, Kerry’s recent instructions have included acting for a claimant in a fire safety defect claim valued in excess of £2,000,000, and representing the defendant in a claim for allegedly negligent immigration law advice with a number of complex causation issues.

Kerry also has experience in representing defendants in claims brought against them for alleged contraventions of the Equality Act 2010.

Kerry’s previous experience as a Government lawyer combined with her private law practice in Chambers means that she has a particular interest in police law.

She accepts instructions on all matters relating to police law, and has been appointed to the panel of Junior Junior Counsel for the Undercover Policing Inquiry.

Kerry accepts instructions on all types of travel and cross border claims, and is keen to build her practice in this area.

Kerry has a particular interest in public sector and human rights claims.

She is well versed in bringing and defending judicial review claims, in particular with a focus on issues relating to immigration and detention, and freedom of information.

While at the Government, she gained experience in immigration litigation, freedom of information requests, local authority powers and environmental issues. She has been appointed to the panel of Junior Junior Counsel for the Undercover Policing Inquiry.
