Giles Mooney KC is a civil practitioner specialising in clinical negligence, professional negligence and personal injury.

His work involves catastrophic injury cases involving brain injury, spinal injury, amputation and birth injuries. Recent settlements for Claimants have included numerous multi million pound awards in cases involving, Cerebral Palsy, Erbs Palsy, Persistent Vegetative State, paralysis, Cauda Equina Syndrome and upper and lower limb amputations.

Giles relishes taking on difficult and novel liability cases and points, both for Claimants and Defendants. His trial advocacy is recognised in the Legal Directories where he has been described as “absolutely masterful” and “able to take a witness apart in cross examination in minutes”.

Expertise

Giles acts in cases involving catastrophic injury.  He is currently working on a number of birth injury (hypoxia brain injury) claims valued in excess of £10 million and failed spinal surgery claims leading to cauda equina and other neurological disorders. Giles has a particular interest and expertise in cases involving informed consent and has been involved in a number of cases testing the boundaries of Montgomery and Chester.

Notable Clinical Negligence & Healthcare cases


CA v NHS Foundation Trust

Giles acted for a Claimant who suffered brain damage as a result of a delayed diagnosis of Herpes Simplex Encephalitis. Liability and quantum were firmly in dispute and Giles secured damages of £1 million plus annual periodical payments of £180,000.

MXH v NHS Trust

Giles acts for a Claimant who suffers from Cerebral Palsy as a result of hypoxic brain injury at birth. Damages are pleaded at in excess of £21 million.

ABC v NHS Trust

Giles acts for a Claimant who suffered severe brain injury as a result of hypoxia caused by placental abruption shortly prior to delivery. Breach of duty and causation were factually, legally and medically complex and fiercely contested by the Defendant. Shortly before trial Giles was able to secure settlement of the liability issue in the course of mediation. Despite the agreed liability split, damages are expected to be several million.

HE v NHS Foundation Trust

Giles acts for a Claimant who sustained motor developmental delay leading to lack of independent mobility as a result of delay in identifying a rare genetic disorder.

Meynell  Croydon Health Services NHS Trust [2018] EWHC 2431 (QB)

Giles acted for a Claimant who suffered peritonitis as a result of delayed diagnosis of appendicitis. Giles was successful at trial in establishing liability and securing damages.

Giles has a healthy Claimant/ Defendant split of personal injury acting in claims of the utmost severity. Giles acts in claims across the range of personal injury actions but has a particular interest in claims involving the notoriously opaque Animals Act 1971. He has been at the forefront of the development of this area of law in recent years having been in three Court of Appeal decisions. In addition Giles has a particular expertise in claims arising from accidents at sea and cross jurisdictional matters.

Notable Personal Injury cases


JFE v SFE

Giles acted for a Claimant who sustained severe brain injury in a traffic accident. The case complicated by fluctuating capacity and disputes between the parties about the Claimant’s life trajectory but for her injury. Settlement was eventually agreed in the sum of £5.5 million.

D v TFL

Giles acts for a Claimant who lost his dominant arm in the Croydon Tram Crash. Damages will be in excess of £3.5 million.

Smith v Tesco [2016] EWHC 3252 (QB)

Giles acted for a Claimant who suffered Cauda Equina Syndrome as a result of an accident at work. Giles was successful in the liability trial and the claim later settled at JSM for £2.25 million.

YW v H

Giles acted for a Claimant who fell from climbing apparatus at an activity centre and suffered severe spinal injuries. Damages of £5.3 million were secures at the JSM.

B v H

Giles acted for the Defendant in a claim brought by a yard jockey who sustained severe spinal injury when thrown from a horse on the gallops.

Croydon Tram Disaster

Giles acts for two of the families of the deceased in this ongoing inquest.

Giles has an increasing practice in the professional negligence sphere. He has acted in cases involving alleged negligence against lawyers, accountants, veterinary surgeons, farriers and architects. He has a particular interest in claims against IFAs including allegations of fraud.

Acting for an IFA accused of fraudulently/ negligently participating in a pension liberation scheme.

Acting for a race horse trainer whose horse died after routine veterinary surgery went wrong.

Acting for a show jumper whose horse (valued at £2 million) was rendered permanently lame by negligent farriery.
