Following the decision of the Court of Justice of the European Union in Case C 629/24, MH v Costa Crociere SpA we ask whether the basis for claims against sea and air carriers will now shift from the Athens and Montreal Conventions (with their two year limitation periods and specific liability regimes) to the Package Travel Regulations (with their three year limitation period and common law liability regime). Sarah Prager KC and Anirudh Mandagere examines this seismic shift in the liability framework in this area.
