Laura Begley and Thomas Jones, instructed by Jon Nicholson of Anthony Gold, acting on a pro bono basis, represented a young German national in his criminal injuries compensation scheme claim for catastrophic brain injuries sustained during an unprovoked assault. The Applicant was visiting the UK when he sustained serious brain damage as a result of the assault, following which the principal assailants were convicted of causing grievous bodily harm with intent. The Applicant was represented through his litigation friend who holds a Guardianship Order in Germany to make decisions regarding his welfare and financial matters. The Applicant is now cared for at home by his family and is in receipt of German state benefits. With judicious and targeted enquiries of the German state funding position, Guardianship and the extent of the Applicant’s disabilities the Applicant secured the maximum award of £500k at the initial decision stage from the CICA without the imposition of a reversionary or permitted purposes trust or the need for a review or appeal to the First Tier Tribunal.
