Aims of the webinar
This webinar will look at two important case law updates from the Administrative Court relevant to the Mental Capacity Act 2005. Edward Lamb will summarise the case of R (Maguire) v HM Senior Coroner for Blackpool & Fylde [2020] EWCA Civ 738: The Court of Appeal reviewed the Administrative Court’s decision to dismiss a claim for judicial review arising out a Coroner’s decision that the inquest into the death of Jackie Maguire was not an Article 2 inquest. Thomas Jones will look at the decision in R on the application of (EG) v Parole Board [2020] EWHC 1457 (Admin): The Administrative Court considered the participation of prisoners who lack capacity in Parole Board hearings.
