John Foy QC and Stuart McKechnie secure compensation of over £11m for a teenager who suffered brain damage after a negligent operation



A teenage boy who suffered catastrophic brain damage following an operation at Walsall Manor Hospital has been awarded compensation with a capitalised value of over £11.5million in his life time.  He went into hospital in 2006 for a surgical procedure but suffered an anaesthetic accident during the surgery which resulted in him needing 24 hour care.

John Foy QC, leading Stuart McKechnie, secured a lump sum payment and index linked and tax free payments to cover the cost of his care that is provided by his family.

Walsall Hospitals NHS Trust admitted liability at the High Court in London and repeated their apology to the boy and his family.

Approving the settlement, the judge expressed his ‘admiration for all that the boy’s parents have done for him’.

In a statement Mr Amir Khan, medical director at Walsall Healthcare NHS Trust said: “The Trust always endeavours to provide the highest quality of care to all of its patients. We would like to take this opportunity to apologise once again for the level of care provided on this occasion.

“This was unacceptable and fell well below our aim to provide a consistently first class experience to those who use our services.”
