Court orders rehabilitation of child to mother following successful appeal

Esther Maclachlan represented a mother in care proceedings which resulted in the local authority’s application for a placement order being dismissed and the court ordering that the child be returned to the mother’s care. 

Esther advised the mother on the prospects of an appeal out of time in April of this year following the conclusion of the initial care proceedings in February which had resulted in the court ordering the child be placed for adoption. 

Esther then represented the mother in her successful appeal which saw the placement orders and final care order made at first instance overturned.  She continued to represent the mother throughout the contested proceedings which followed the appeal.

The court concluded on 20 November 2015 after a four day hearing and dismissed the local authority’s application for a placement order and ruled that the child be rehabilitated back to the mother’s care with a package of support in place.
